DMCA Safe Harbor Statement
JamzPro™ LLC respects the intellectual property rights of all creators and expects users of our platform to do the same. JamzPro™ complies with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512, and related intellectual property laws.
JamzPro™ qualifies as an online service provider under the DMCA and maintains safe harbor protections for user-submitted content. We respond promptly to valid notices of alleged copyright infringement and maintain a policy of terminating the accounts of repeat infringers as described in Section 5 of this policy.
JamzPro™ does not independently review all user-submitted content for copyright compliance, and the presence of any content on the platform does not constitute an endorsement or assertion of copyright ownership by JamzPro™.
Content Ownership
Performers retain full ownership of all original musical works, recordings, performances, and creative content they upload to JamzPro™. Uploading content to a JamzPro™ performer profile does not transfer copyright ownership to JamzPro™.
By uploading content to JamzPro™, you grant JamzPro™ a limited, non-exclusive, royalty-free, worldwide license to display, reproduce, and distribute that content for the purposes of operating and promoting the JamzPro™ marketplace — including but not limited to displaying the content on your profile, in search results, in platform marketing materials, and in press and media about JamzPro™.
This license does not permit JamzPro™ to sell, license, or sublicense your content to third parties outside of normal marketplace operations. You may remove your content at any time by deleting it from your profile or deactivating your account.
Media Upload Warranty
By uploading any photo, audio recording, video recording, or other media to your JamzPro™ profile, you represent and warrant that:
1. You own the copyright in the uploaded media, or have a valid license from the copyright owner to use and sublicense the media on JamzPro™.
2. The media does not infringe on the copyright, trademark, right of publicity, or other intellectual property rights of any third party.
3. If the media includes performances of copyrighted musical compositions, you have obtained all necessary performance and synchronization licenses, or the performances fall within applicable fair use or fair dealing provisions.
4. If the media includes other persons' likenesses, you have obtained all necessary releases and permissions from those individuals.
JamzPro™ may remove media that appears to violate these warranties, and repeated violations may result in account suspension.
How to Submit a DMCA Takedown Notice
If you believe that content on JamzPro™ infringes your copyright, you may submit a DMCA takedown notice to our designated copyright agent. To be valid, your notice must include all of the following required elements:
1. Your name, address, telephone number, and email address (as the copyright owner or authorized representative)
2. A description of the copyrighted work you claim has been infringed
3. A description of where the allegedly infringing material is located on the JamzPro™ platform, including a direct URL to the content
4. A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law
5. A statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or are authorized to act on behalf of the copyright owner
6. Your physical or electronic signature

JamzPro™ will respond to valid DMCA notices within 5–10 business days.
Counter-Notice Process
If your content was removed in response to a DMCA takedown notice and you believe the removal was in error or based on misidentification, you may submit a counter-notice.
A valid counter-notice must include:
1. Your name, address, telephone number, and email address
2. Identification of the material that was removed and where it appeared before removal
3. A statement under penalty of perjury that you have a good-faith belief that the material was removed as a result of mistake or misidentification
4. A statement that you consent to the jurisdiction of federal district court for the judicial district in which your address is located (or, if outside the US, to the jurisdiction of any judicial district where JamzPro™ may be found)
5. A statement that you will accept service of process from the party who submitted the original takedown notice
6. Your physical or electronic signature
Submit counter-notices to support@jamzpro.com with "DMCA Counter-Notice" in the subject line. If a valid counter-notice is received, JamzPro™ will provide a copy to the original complainant and restore the content within 10–14 business days unless the complainant seeks a court order.
Repeat Infringer Policy
JamzPro™ maintains a repeat infringer policy in accordance with the DMCA. Users who receive multiple confirmed copyright infringement notices — typically two or more valid, uncontested DMCA takedown notices against content they uploaded — are considered repeat infringers and their accounts will be terminated.
JamzPro™ tracks DMCA notices on a per-account basis. Counter-notices that are upheld (no court order obtained by the complainant) are not counted against the user's record.
JamzPro™ may terminate accounts in cases of even a single serious infringement at our sole discretion, particularly in cases involving willful infringement of commercially valuable content.
Original Music & Performance Rights
JamzPro™ is a marketplace for live entertainment services. Many performers on JamzPro™ perform copyrighted musical compositions as part of their professional services.
JamzPro™ is not responsible for ensuring that performers have obtained all necessary public performance licenses for the musical works they perform at events. This responsibility rests with the performer (who may need synchronization or performance rights), the event venue (which may hold a blanket public performance license through ASCAP, BMI, or SESAC), or the event organizer, depending on the jurisdiction and circumstances.
Performers are encouraged to consult with an entertainment attorney regarding their licensing obligations, particularly for wedding, corporate, and public event performances.
