Independent Contractor Status
You are an independent contractor, not an employee of JamzPro™. You are solely responsible for your own taxes, including federal and state income taxes and self-employment taxes. JamzPro™ will issue a Form 1099-NEC for earnings exceeding $600 in a calendar year. You are not entitled to employee benefits of any kind.
No employer-employee relationship exists between you and JamzPro™. JamzPro™ does not direct, supervise, or control the manner in which you provide your services. You retain full control over how, when, and where you perform your services. JamzPro™ is not responsible for workers' compensation, unemployment insurance, health benefits, or any other employment benefits.
Subscription Plans & Fees
JamzPro™ is a discovery and booking marketplace. Clients pay performers directly — JamzPro™ does not process, split, or hold payments on behalf of any party. There are no per-booking fees or commissions deducted from your earnings.
JamzPro™ earns revenue through optional Pro and Elite performer subscription plans. These plans unlock features including featured placement, priority search ranking, unlimited media uploads, and advanced analytics. Subscription fees are billed monthly or quarterly and are clearly displayed on the pricing page.
A free tier is available to all performers with no subscription fee required to list a profile and receive booking inquiries. You set your own rates and keep 100% of what you charge your clients.
Cancellation Policy
If you cancel a confirmed booking without adequate notice, JamzPro™ may reduce your search visibility or suspend your ability to receive new booking requests. Repeated cancellations may result in profile suspension or removal from the platform.
Cancellations must be communicated through the JamzPro™ messaging system — cancellations communicated outside the platform may not be recognized and do not relieve you of your obligations.
JamzPro™ tracks your cancellation history. A pattern of cancellations (3 or more confirmed bookings cancelled in a 12-month period) may result in account review, suspension of new booking requests, or permanent removal from the platform.
Because clients pay performers directly, any refund obligations arising from a cancellation are between you and your client. JamzPro™ does not process or guarantee refunds.
Cancellation & Refund Policy
Because clients pay performers directly, refunds and cancellations are matters between you and your client. JamzPro™ does not process refunds or hold funds on behalf of either party.
You are encouraged to establish clear cancellation and refund policies in your performer profile and in any booking agreements you use with clients. JamzPro™ provides contract templates to help you formalize these terms.
JamzPro™ may review disputes between performers and clients as described in Section 8, but is not responsible for resolving financial matters between independent parties.
Payment Disputes
JamzPro™ does not process payments and therefore is not responsible for payment disputes between clients and performers. All payment matters are between you and your clients.
You are responsible for maintaining documentation of service delivery (set lists, photos, communication records, signed agreements) that may be used to resolve payment disputes with clients.
JamzPro™ may provide mediation assistance for booking disputes as described in Section 8, but has no authority to compel payment or issue refunds on behalf of either party.
Prohibited Conduct
You may not:
(a) Use JamzPro™ to source clients and then deliberately move the relationship entirely off-platform to avoid ever using the platform again — this undermines the marketplace that helps clients find you;
(b) Provide false information in your performer profile, including misrepresenting your identity, credentials, experience, availability, or performance history;
(c) Engage in discriminatory conduct toward customers based on race, color, religion, national origin, sex, disability, sexual orientation, or any other protected characteristic;
(d) Use the platform for any unlawful purpose, including fraud, money laundering, or copyright infringement;
(e) Share login credentials, create duplicate profiles, or impersonate another performer;
(f) Engage in harassment, abuse, or threatening conduct toward any platform participant, including customers, other performers, or JamzPro™ staff;
(g) Post fake reviews, solicit reviews in exchange for compensation, or manipulate the platform's review system.
Violation of any prohibited conduct clause may result in immediate suspension or permanent removal from the platform, at JamzPro™'s sole discretion.
Platform Removal Rights
JamzPro™ reserves the right to suspend, deactivate, or permanently remove any performer profile at its sole discretion, including but not limited to: fraud, policy violations, repeated cancellations, customer complaints, chargeback patterns, or conduct deemed harmful to the platform or its users.
JamzPro™ is not obligated to provide advance notice of removal. In non-emergency cases, JamzPro™ will attempt to notify you and may provide an opportunity to correct the violation before taking action. For serious or urgent violations, JamzPro™ may act immediately without prior notice.
You may appeal a suspension or removal decision within 14 days by contacting support@jamzpro.com. Because JamzPro™ does not process performer payments, any outstanding payment obligations are between you and your clients and must be resolved directly with them.
Dispute Resolution
Any disputes arising from this agreement or your use of the JamzPro™ platform shall be resolved through binding arbitration under the rules of the American Arbitration Association (AAA), conducted in the State of Florida (or by videoconference by mutual agreement).
You waive your right to participate in class action lawsuits against JamzPro™. This agreement is governed by the laws of the State of Florida, without regard to conflict of law principles.
If any provision of this agreement is found unenforceable, that provision shall be modified to the minimum extent necessary so that the remainder of this agreement continues in full force and effect.
Intellectual Property
By uploading media (photos, videos, audio) to your performer profile, you grant JamzPro™ a non-exclusive, royalty-free, worldwide license to display, reproduce, and promote that content for the purpose of operating and marketing the platform.
You retain full ownership of all content you upload. You represent and warrant that you own or have obtained all necessary permissions for any content you submit, and that your content does not infringe on the rights of any third party.
This license does not transfer ownership of your content to JamzPro™ and does not permit JamzPro™ to sell or license your content to third parties outside of normal marketplace operations. You may withdraw this license by removing your content or deactivating your account.
Modifications
JamzPro™ reserves the right to modify this agreement at any time. You will be notified of material changes via email or prominent notice on the platform, and may be required to re-accept the updated terms to continue using the platform.
Continued use of the JamzPro™ platform after changes take effect constitutes your acceptance of the revised agreement. If you do not agree with the modified terms, you must cease using the platform and contact support@jamzpro.com to close your account.

Acceptance is recorded electronically with timestamp and IP address for legal compliance.
