JamzPro™ is a marketplace technology platform that connects independent performers with event buyers. JamzPro™ is not a party to the booking agreement between you and the performer, and is not responsible for the quality, delivery, or outcome of any performance.
Performers on JamzPro™ are independent contractors operating their own businesses. JamzPro™ does not employ, manage, or supervise any performer. In the event of a performer no-show or failure to deliver services, JamzPro™ will offer mediation support and dispute resolution assistance, but is not liable for the actions or omissions of independent performers.
By submitting a booking request, you acknowledge that JamzPro™ acts solely as a facilitator and technology intermediary.
Booking Request Process
Submitting a booking request through JamzPro™ constitutes an inquiry to an independent performer — it does not create a confirmed booking or payment obligation until both parties agree to the booking terms.
A booking is confirmed when: (a) the performer accepts your request, and (b) both parties agree on the event details, pricing, and payment terms directly.
JamzPro™ does not process payments on behalf of performers or customers. All payment arrangements are between you and the performer directly.
Payment Terms
JamzPro™ is a discovery and booking marketplace. We do not process, hold, collect, split, or distribute payments between customers and performers.
Payment method, timing, deposit requirements, and refund terms are agreed upon directly between you and the performer. Common arrangements include: a deposit to hold the date (paid to the performer directly), full payment at the event, or invoiced payment.
JamzPro™ is not responsible for payment disputes, non-payment, refunds, or chargebacks between customers and performers. You are solely responsible for any payment arrangements you enter into with a performer.
All prices are in US dollars. You are responsible for any applicable taxes in your jurisdiction.
Cancellation & Refund Policy
Because JamzPro™ does not process payments, refund and cancellation terms are between you and the performer directly. JamzPro™ cannot issue refunds for performer services.
We encourage you to discuss and agree on cancellation and refund terms with the performer before confirming a booking. JamzPro™ provides contract templates to help you formalize these terms.
JamzPro™ may provide mediation assistance for booking disputes as described in the Dispute Resolution section, but has no authority to compel payment or issue refunds on behalf of either party.
If a performer cancels your confirmed booking, you should work directly with the performer to recover any deposit paid. JamzPro™ can assist with dispute documentation and mediation, but is not responsible for the financial outcome.
Prohibited Use & Chargebacks
You may not use JamzPro™ for any unlawful purpose, including fraud, misrepresentation, or money laundering.
Initiating a chargeback with your credit card issuer for services that were delivered as agreed is fraudulent and a violation of this agreement. If you have a genuine dispute about services not rendered or materially different from what was agreed, you must first submit a dispute through JamzPro™'s resolution process.
Fraudulent chargebacks may result in: (a) permanent ban from the JamzPro™ platform; (b) referral to law enforcement; (c) recovery of chargeback amounts and associated fees through legal means.
If you experience a performer no-show or a performance materially different from what was booked, contact JamzPro™ support at support@jamzpro.com immediately. JamzPro™ will investigate and facilitate a resolution, which may include a full or partial refund.
Platform Liability & Limitations
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, JAMZPRO™, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM OR ANY BOOKING MADE THROUGH IT.
JAMZPRO™ IS NOT RESPONSIBLE FOR: (A) PERFORMER NO-SHOWS OR CANCELLATIONS; (B) PERFORMANCE QUALITY OR OUTCOMES; (C) PERSONAL INJURY OR PROPERTY DAMAGE AT EVENTS; (D) ANY DISPUTES BETWEEN YOU AND THE PERFORMER.
JAMZPRO™'S TOTAL LIABILITY TO YOU FOR ANY CLAIMS SHALL NOT EXCEED THE TOTAL SUBSCRIPTION FEES PAID BY YOU TO JAMZPRO™ IN THE SIX (6) MONTHS IMMEDIATELY PRECEDING THE CLAIM.
Dispute Resolution
Any disputes arising from this agreement or your use of the JamzPro™ platform that cannot be resolved through JamzPro™'s internal support process shall be resolved through binding arbitration under the rules of the American Arbitration Association (AAA), conducted in the State of Florida (or by videoconference by mutual agreement).
You waive your right to participate in class action lawsuits against JamzPro™. This agreement is governed by the laws of the State of Florida, without regard to conflict of law principles.
Before initiating arbitration, you must first contact JamzPro™ support at support@jamzpro.com and allow 30 days for good-faith resolution of the dispute.
Privacy & Data Usage
By using JamzPro™, you agree to our Privacy Policy available at jamzpro.com/privacy. JamzPro™ collects, stores, and uses your personal data as described in the Privacy Policy, including sharing necessary booking information with the performer you contact.
Your contact information and event details will be shared with the performer upon booking inquiry acceptance. JamzPro™ does not sell your personal data to third parties for advertising purposes.
Because JamzPro™ does not process customer-to-performer payments, payment data for your booking is handled directly by you and the performer. JamzPro™ does not collect or store your payment information for performer bookings.
Modifications
JamzPro™ reserves the right to modify this Customer Booking Agreement at any time. You will be notified of material changes via email or prominent notice on the platform.
Continued use of the JamzPro™ platform after changes take effect constitutes your acceptance of the revised agreement.
